I have purchased " Russian Green Enamel Diamond 14K Pink Gold Earrings " from this PowerSeller and paid layaway of $1100 with PayPal.I have found out after that the earrings are not old althow they have hallmaks and the gold content was misrepresented. Asked the seller exceljewels for refund.They offered STORE CREDIT or money back when they will sell the item to a different buyer...the refund will be a FAVOR.They relisted the item with correction, wanted to keep my money indefinetely.They took advantage that it is an international transaction. After a month of waiting I told them that I will leave negative feedback...their reply was: "Sure, you have a right to do so. However, say goodbye to $1100."Left negative feedback waiting for Ebay to help the situation. PayPal did not refund. LAYAWAYS are considered service and are NOT PROTECTED by PAYPAL.Asked about seller bussiness information and they DID NOT RESPOND!!

Got p@@@ed of and bought more items from the seller and from his "associate" from NY with the same kind of FINE PRINT.Ebay removed my negative defamatory feedback to PayPal&seller and closed my accounts. I expected that.After losing $1100 I do not recommend ebay services.The PowerSeller feedback is not accurate.

The seller relisted the item (look it up!)without finishing the transaction with me and ebay is closing the eyes. I have a PayPal receipt of $1100 for the same item. I will not longer do business with Ebay or PayPal!!

The user took advantage of our layaway plan. As clearly stated in the item description layaway deposits are not refundable. She paid 1/3 down = $1100. After about three weeks the user asked for refund because her husband said they need money to pay the bills. The user even didn't see the item in person to complain about quality. Impulsive buyer, she is not familiar with Ebay rules. We were generous and offered refund after another buyer would buy the item or exchange it with something else. Reported to FBI since the user is really dangerous. On the file for dangerous foreigners (Poland).

Hi exceljewels
I think that line alone shows you in bad light as you can not report someone to the FBI just like that, you have to go through the police and even if you could report this person to the FBI who, let us not forget this, paid you money, what does that say about you? Why you have to make a deal out of them being in Poland also beats me unless you are a nationalistic American, which the world is better off without! FYI Poland is part of the EU and if this buyer somehow is the fraudster, they would face justice. But again, how they are the bad guys when they are the ones out of pocket, beats me. So, if you are so honorable and law abiding and good, why not show the world and refund them?

Our policy is clear and easy to understand: layaway deposits are not refundable. The buyer was really nasty. She sent us numerous illogical emails, contradict with each other, she even asked us for our business information and she explained why she needs it: to come and put a bomb under our office! What a silly and childish idea!
We have 100% feedbacks and there is a reason. All people are different, in general all customers are good people. However, some buyers should not shop on Internet since they just cannot figure out how it works. About nationalism: we said nothing against Poland or the customer. We just pointed out she is international customer from Poland. Come on, don't try to catch people for no reason. I'm from Europe as well.

The facts are you have a lay away policy that allows you to keep other people's money if they default, even if through no fault of their own or because of hard times, and to resell the expensive item to someone else. Also, critically, even though the buyer believes you have actually misrepresented the goods (are committing fraud) and so wants to cancel, perhaps quite rightly. So you made a lot of money from this buyer. Just because eBay, who are as crooked as they come in my opinion, allow you to get away with it (it being legalized theft in some's opinion), doesn't make it right. So, show you are the good person if you have sold the item to someone else and refund this person's money. Otherwise, I do not care what eBay and your law say, you are a crook.

As for the buyer threatening to put a bomb in your office, I can imagine they were upset with losing all that money. As for your reporting that to the FBI, it just goes to show what a pathetic little person you are. Here, I am also going to put a bomb in your office (I suspect your smallest room); report me to the FBI as well.

Finally YOU raised the issue of this person's nationality / location when there was absolutely no need or call to do so. I have no doubt this was done to demean the buyer; I find certain people, especially in the USA, think it is clever to demean Poles. I do not care where you are from, though I note many Americans claim when they need some form of vindication to be "from Europe", your words were clearly to me racist, an attempt to demean this person on the basis of their nationality (actually Poland has a superb cultural heritage and I never understood the references to Poles as idiots).

At the end of the day;
1) They have doubts about your claims regarding the item (they believe you were selling fraudulently).
2) You have now sold the item to someone else.
So are you going to refund this person and show you have humanity / ethics rather then just allude to them?
Your time on the internet is not your real life.
God bless the EU
